These terms and conditions govern your access to and use of Claibe's AI-powered image processing platform.

Acceptance of Terms

By accessing or using our services, you agree to be bound by these terms. If you do not accept these terms, you must not use our services.

Claibe ApS is a Danish company registered in Denmark. We provide AI-powered image processing to businesses through our SaaS platform.

Account Registration

Creating an Account

When you create an account with us, you must:

• Be of legal age (18 years or older)
• Represent a company with a valid CVR number
• Provide accurate and up-to-date information
• Keep your login credentials confidential

Account Security

You are responsible for:

• Maintaining the security of your account
• All activities under your account
• Immediately notifying us of unauthorized access

Subscriptions and Payment

Subscription Types

We offer the following subscriptions:

• BASIC: 325 DKK/month (260 DKK/month with annual payment)

  • 1 user access
  • Curated workflows ready for commercial use
  • Built-in guides

• PRO (Recommended): 950 DKK/month (760 DKK/month with annual payment)

  • For a small commercial team
  • 800 images per month
  • 3 users access
  • Curated workflows ready for commercial use
  • Built-in guides
  • Token roll-over for 30 days
  • Image upscaling and enhancement
  • Support responds within 2 business days

Payment Terms

• Payment is charged in advance monthly or annually
• All prices exclude Danish VAT (25%)
• We accept payment via card and other electronic payment methods
• 20% discount with annual payment

Free Start

• Start free with 50 image generations
• No credit card information required
• Upgrade to paid subscription whenever you want
• Commercial license included in all packages

Image Token Calculation

Image tokens are deducted from your subscription based on the following rules:

• Successful generations: For each successfully generated output, 1-4 image tokens are deducted depending on the workflow
• Failed requests: If a request fails, the token is automatically returned to your account
• Batch output: You can adjust the batch output size to minimize image tokens used per request
• Upscaling: The upscaler feature is a separate function that costs 10-20 image tokens per image output, depending on the upscaling factor

These rules ensure that you only pay for successful image generations and that you have flexibility to optimize your token consumption.

User Rights and Responsibilities

Your Rights

You have the right to:

• Use the platform for commercial purposes
• Own the rights to all content you create with the AI tools
• Export your images at any time
• Cancel your subscription with immediate effect
• Use generated images commercially with full copyright
• Access curated workflows optimized for professional use

Your Responsibilities

You agree to:

• Comply with Danish law
• Respect others' intellectual property rights
• Not upload illegal or offensive content
• Not attempt to hack or abuse the platform
• Not share your account with persons outside your organization

Intellectual Property and AI Generation

Your AI-Generated Content

• You retain all rights to images you create with our AI tools
• Generated images can be used commercially without restrictions
• We do not train our AI models on your uploaded images
• You are responsible for having rights to uploaded material

Our Platform and AI Technology

• Claibe's platform, AI tools, and workflows are our property
• You receive a non-exclusive license to use the platform
• You may not copy, modify, or reverse-engineer our software
• AI tools include: image generation, upscaling, material testing, character consistency, packshots, and contextual editing

Data Protection and Privacy

We process personal data in accordance with our privacy policy and GDPR. Read more in our separate privacy policy.

Data Storage and Security

• All data is stored on servers in the EU (primarily Denmark and Germany)
• End-to-end encryption of all uploaded images
• Data is deleted 30 days after account deletion
• You can request data deletion at any time
• No data is transferred to countries outside the EU

Limitation of Liability

Our Liability

Claibe is not liable for:

• Indirect losses or consequential damages
• Lost profit or data
• Temporary service interruptions
• Force majeure events

Our total liability cannot exceed the amount you have paid in the last 12 months.

Warranty

We provide no warranties beyond what Danish law requires. The platform is provided "as is".

Support

Support Scope

We offer:

• Email support in Danish
• Response within 2 business days for PRO customers
• Dedicated support for ENTERPRISE customers
• Built-in guides and tutorials on the platform

Training and Onboarding

ENTERPRISE customers have access to:

• Personal onboarding
• Dedicated support
• Priority handling of inquiries

Termination

Your Termination

• You can cancel at any time
• No commitment or notice period
• Prepaid subscriptions are not refunded

Our Termination

We may terminate your access if you:

• Violate these terms
• Abuse the platform
• Do not pay on time
• Exhibit fraudulent behavior

Changes to the Terms

We may change these terms with 30 days' notice. Significant changes will be notified via email. Continued use after changes take effect constitutes acceptance.

Disputes and Governing Law

Governing Law

These terms are governed by Danish law.

Dispute Resolution

• We first attempt to resolve disputes amicably
• Unresolved disputes are settled in Danish courts
• Venue is the court in Copenhagen
